Remote sellers cross economic nexus when gross revenue from sales delivered into New Jersey exceeds $100,000, or when they make 200 or more separate transactions delivered into the state, in the current or prior calendar year. Either prong alone triggers the obligation. Two exemptions shape category strategy more than the rate itself: articles of clothing and footwear for human use are exempt, and most food sold as grocery items is exempt as well. The clothing carve-outs are worth knowing before writing category copy — fur clothing, accessories such as handbags and jewelry, sport or recreational equipment, and protective equipment are all taxable, though protective equipment necessary for the daily work of the user is exempt. Note also that specified digital products such as downloaded audio, video and e-books are taxable here. Apparel merchants should state the exemption explicitly on New Jersey-facing pages, because a tax-free price is a conversion argument the SERP competition frequently leaves unstated.
