Florida charges a flat 6% state sales tax, but every sale is sourced to the buyer's county, and each county may add a discretionary sales surtax on top.
On the Department of Revenue's own county surtax schedule (Form DR-15DSS), the counties that levy a surtax sit at 0.5%, 1%, 1.5% or 2%, and some counties levy none at all, so combined rates across the state range from 6% to 8% depending on where the package lands. Florida uses destination-based sourcing for remote sales, which means an out-of-state seller's rate is set by the customer's delivery address, not the warehouse. One statewide rate does not exist in practice, and a checkout that quotes a single Florida rate will be wrong for much of the state.
Florida's economic nexus threshold is more than $100,000 in taxable remote sales delivered into the state over the previous calendar year; published state-by-state nexus guides list a dollar threshold only for Florida, with no companion transaction-count prong, and the collection duty starts with the calendar year after the threshold is met. There is a distinctly Florida wrinkle on the surtax: per the Department of Revenue, for certain transactions only the first $5,000 of a taxable sale or purchase is subject to the discretionary surtax, while the 6% state portion applies to the whole amount. That cap is worth confirming in the tax engine before a high-ticket catalog goes live. Groceries and prescription drugs sit on the Department's nontaxable list (Form DR-46NT, "Nontaxable Medical Items and General Grocery List"), and the legislature runs recurring sales tax holidays — the Department published back-to-school and hunting/fishing/camping holiday notices again for 2026 — which create predictable, dateable demand spikes.
Two changes matter for Florida operators specifically. Chapter 2025-208, Laws of Florida (HB 7031), states at Section 37: "Effective October 1, 2025, section 212.031, Florida Statutes, is repealed" — that is the state sales tax on the rental of real property, so the cost of holding warehouse and retail space here dropped. Separately, the Florida Telephone Solicitation Act (Fla. Stat. 501.059), the state's mini-TCPA, governs SMS and call follow-up on leads: subsection (8)(a) bars automated or recorded-message sales calls without the called party's prior express written consent, and subsection (10) gives an aggrieved called party a private right of action for actual damages or $500, whichever is greater, trebled for willful or knowing violations.
